You may avail yourself of our Services and visit our website without making any statements about your person. RECORDING OF NON-PERSONAL DATA WHEN USING OUR INTERNET PRESENCE

We do not have any possibility of linking IP address and any personal data that might be available to us. The data stored will be used exclusively for the purposes of identifying and tracking of any unauthorised accesses or attempted accesses to the web server as well as for statistical analyses such as number of visitors and popularity of the site and for improving our online presence. These data will be used exclusively by us. They shall not be forwarded to any third parties.

E-MAIL ADVERTISING WITHOUT REGISTRATION FOR OUR NEWSLETTER AND YOUR RIGHT OF OBJECTION

Should we receive your e-mail address in connection with the sale of goods or services, and you do not raise any objection to this, we reserve the right to send you regularly by e-mail, on the basis of Section 7 Para. 3 UWG (Act against Unfair Competition), offers regarding products from our range similar to those already purchased. This serves the upholding of our, in the context of the weighing up of interests, overriding legitimate interest in making promotional approaches to our customers.

COLLECTION AND USAGE OF PERSONAL DATA

In order for us to be able to make certain Services and the processing of contracts possible, the collecting of personal data is unavoidable. We then ask and store your standard data (name, address and company name) and contact data (e.g. e-mail, telephone numbers). We also process contractual data (e.g. the object of a contract, running term, customer category) and payment data (e.g. bank details, payment history).

In the context of our cooperation with external services providers we may possibly receive personal data concerning you from said providers. These include, for example, credit bureaus, services providers, tradesmen or business partners.

LEGAL BASIS FOR THE PROCESSING

In accordance with the criteria of Art. 13 GDPR we inform you as to the legal bases for our data processing. The legal basis for processing depends in each respective case upon the purpose for which the data are processed.


If you have granted us your consent for the processing of your personal data, we base the processing on your consent granted according to Art. 6 Para. 1 lit. a) GDPR.


The processing of your personal data may, however, also be necessary on the grounds mentioned in the following, for example in order to fulfil a contract concluded with you, to implement any pre-contractual measures demanded by you and in order to make our Services available to you (e.g. the processing of orders and conclusions of rental contracts, feedback requests, online surveys regarding our business relationship, offers, invoices, payment reminders) as well as to fulfil our statutory obligations (Art. 6 Para. 1, Clause 1 lit. a to c GDPR). The transmission of your personal data to third parties for any purposes other than those listed in the following shall not take place. We shall only forward your personal data to third parties if and insofar as:

  • You should have granted your explicit consent hereto in accordance with Art. 6 Para. 1 Clause 1 lit. a GDPR,
  • the forwarding should be necessary in accordance with Art. 6 Para. 1 Clause 1 lit. f GDPR for the purpose of asserting, exercising or defending legal claims and there are no grounds for supposing that you have an overriding protection-worthy interest in your data not being forwarded,
  • there should be a statutory obligation to forward your data according to Art. 6 Para. 1 Clause 1 lit. c GDPR, as well as if
  • this should, according to Art. 6 Para. 1 Clause 1 lit. b GDPR, be necessary for the processing of contractual relationships with you, such as in the case of forwarding to external services providers that support us in our business operation.

Our employees and partners have been subjected by us to obligations of secrecy and to adherence to the laws on data protection.

TRANSMISSION OF DATA TO THIRD COUNTRIES

Should we share your personal data in accordance with this data protection declaration, this might also entail the transmission of said personal data to countries outside the Europeans Economic Area (EEA). Whenever we transmit your personal data to countries outside the Europeans Economic Area, we always ensure that an adequate level of protection is guaranteed in those countries by way of – insofar as this is prescribed by law – ascertaining that at least one of the following appropriate guarantees is given:

STORAGE PERIOD, DELETION OF PERSONAL DATA

The data we process will, in accordance with Articles 17 and 18 GDPR, be deleted or the processing thereof be restricted. Inasmuch as no explicit statement should be included in this data protection declaration, the data stored with us shall be deleted as soon as they are no longer required for their intended purpose and no statutory storage requirements should stand in the way of the deletion thereof. Insofar as the data are not deleted as they are required for other, legally permissible, purposes, the processing thereof will be restricted. In other words, the data will be blocked and used for no other purposes. This shall apply, for example, to data that must be kept for reasons under commercial or fiscal laws.

You possess various rights with regard to data affecting your person. In some exceptional cases, Google might transmit the full IP address to a server in the USA and shorten it there. REVIEW OF CREDITWORTHINESS & CREDIT SCORING

Lendis GmbH, as a general rule, grants its customers the possibility of purchasing goods using uncertain methods of payment (e.g. invoice, financing). Companies that, as a general rule, permit their customers the use of uncertain methods of payment have a legitimate interest in protecting themselves as best as they possibly can against defaults on payments. In the course of offer processes we therefore, where necessary, review the creditworthiness of your company and/or of you as a private person. For this purpose we transmit the following data to so-called credit agencies that cooperate with us: company name, your name, address and, if necessary, your date of birth. We hereby send your personal data for a review of your creditworthiness to the following companies


In order to arrive at a decision regarding the establishment, implementation or termination of a contractual relationship, we also use, in addition to a check on your address, information pertaining to your past payment morale and probability values regarding your future conduct, which are calculated, inter alia, using address data. We acquire this information from the following providers:

The information concerning creditworthiness and our own analyses may contain probability values (score values) that are calculated on the basis of scientifically recognised mathematic/statistical methods and which are calculated, inter alia, using address data. The legal basis for this is Article 6 Para. 1 lit. f) GDPR. Our legitimate interest is derived from our interest in reducing the contractual risk, protection against losses of receivables and against the danger of abusive availment of our Services by third parties. Your protection-worthy concerns will be taken into account in accordance with the statutory regulations.
We shall furthermore send information concerning late payments or the loss of any receivables, provided the other statutory prerequisites are given, to the credit agencies that cooperate with us such as Schufa Holding AG, Wiesbaden or Creditreform Boniversum GmbH. The legal basis for this is Article 6 Para 1 lit. f) GDPR. Our legitimate interest is derived from our both our own interest and that of third parties in the reduction of contractual risks for future contracts.

LEADFEEDER

Concurrently with Google Analytics, this website also uses the Leadfeeder service, which is operated by Liidio Oy, Mikonkatu 17, 0100 Helsinki, Finland. Leadfeeder accesses the list of IP addresses of visitors to the website provided by Google Analytics in its evaluation and links the list of IP addresses to information about those companies that may be found on the internet under those IP addresses. Due to the shortening of the IP addresses of visitors to the website already implemented by Google Analytics, this will not result in a direct link to a particular person being created. Ads is an online advertising programme. In the context of this online advertising programme we work with conversion tracking. SEGMENT

Segment: in our internet presence we use “Segment”, a service offered by Segment.io, Inc., 100 California Street, Suite 700, San Francisco, CA 94111, USA (hereinafter referred to as: “Segment”). Segment stores and processes information relating to your user conduct on our internet presence. For this purpose, Segment uses, inter alia, cookies, i.e. small text files that are stored locally on your terminal device in the cache of your web browser and enable the analysis of your usage of our internet presence.


We use Segment for marketing and optimisation purposes, in particular to analyse the usage of our internet presence and to continuously improve individual functions and offers and the usage experience. In order to improve the user experience in our applications we use the service Intercom provided by the company Intercom Inc. for the sending of messages by e-mail and for live chats. The personal data we supply to Intercom are your e-mail address and your name.

For the sending of our newsletter we use the e-mail marketing tool MailChimp. MailChimp is a product of The Rocket Science Group, LLC, 512 Means Street, Ste 404 Atlanta, GA 30318 and has acquired a EU/US Privacy Shield certification.

TRACKING BY ELDAR

When you call up our internet sites, the ELDAR server stores the following data:

  • The type and version of browser used
  • the operating system used,
  • the pages of our website that were accessed,
  • date and time of your access,
  • your internet protocol address (IP address) and
  • your internet service provider.


We use these data in an anonymised form, i.e. without the possibility of being able to identify you,

ELDAR researches automatically, which legal entity (company) has registered your IP address, which clearly does not support any private or mobile usage. Only if this should be the case does ELDAR store the company name and research the data pertaining to the company name that are publicly accessible on the internet or from credit agencies. The IP address will be deleted as soon as its relatedness to the company has been ascertained. ELDAR combines the publicly accessible data with a summary of which pages within our website were visited when and hands this data record over to our sales personnel for the purpose of establishing marketing contact with your company. The report shall contain no data whatsoever that point to or enable you to be identified personally. ELDAR is operated only on servers that are located in Germany. The legal basis for the processing of personal usage data is Article 6 Para. 1 Sub-paragraph 1 lit. f GDPR.
OPTANIUM GmbH collects and processes these data on behalf of Lendis GmbH on the basis of the order processing contract in accordance with Art. 28 Para. 3 Clause 1 GDPR.

PROFILING
